Since 1 January 2016, lawyers, judges, businesses and citizens are invited to change their ways in the management of disputes. Cooperation, negotiation and solutions tailored to the specific needs of the parties are now the guiding principles for lawyers when litigation arises.
Following extensive consultation with stakeholders from the judiciary, citizens and groups involved with the management of litigation before the courts, the Quebec government has implemented a major overhaul of the ways of doing in of civil procedure.
This reform Parliament wishes to emphasize the use of methods of prevention and dispute resolution, such as negotiation, mediation, arbitration and settlement conference amicably presided over by a judge.
