Mexican Data Protection Agency – INAI
Recently elected President Mrs. Claudia Sheinbaum has confirmed the extinction of the Mexican National Institute of Transparency, Access to Information and Protection of Personal Data (INAI, Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales).
Tasks of INAI
Said autonomous governmental entity oversees two main areas regarding personal data protection by the legal framework of:
- the Federal Law on Protection of Personal Data Held by Private Parties ((Ley Federal de Protección de Datos Personales en Posesión de los Particulares, LFPDPPP) and
- the General Law on Protection of Personal Data Held by Obligated Subjects (Ley General de Protección de Datos Personales en Posesión de Sujetos Obligados, LGPDPPSO).
The first refers to private entities and the second to transparency in the public sector.
Planned elimination of INAI
The current Federal Government sets forth that there is no need for an autonomous entity to take care of these duties and by killing INAI there will be significant savings.
Bear in mind that this legal change is part of the intention of extinguishing other six autonomous governmental entities.
Apparently, the former Ministry of Public Administration (now the Anti-Corruption and Good Government Secretariat) part of the Federal Government will take over the functions of INAI.
The above will produce a major change on the treatment of personal data of individuals and on the transparency commitment to the people with a Federal Government that would be part and judge on these matters.
